The incident occurred during Leicestershire's Championship match against Essex between July 21-24.

Umpires Steve Garratt and John Holder reported O'Brien to the ECB, and it was announced today that it was a Level One breach of the code.

This penalty remains on O'Brien's record for a period of two years, and any further Level One breach during that period will result in a further three penalty points.
