Sri Lanka: Argument fixed for preliminary objection

The Court of Appeal yesterday fixed arguments for July 15 on the preliminary objections raised by the plaintiff-respondent in the Board of Control for Cricket in Sri Lanka (BCCSL) case that Saliya Ahangama, an Ex-co member had not submitted the affidavit to court according to the law.

The Bench comprised President of the Court of Appeal, Justice P. Edussuriya and Justice Nissanka Udalagama.

At the outset President's Counsel Romesh de Silva, senior counsel for plaintiff respondent, Clifford Ratwatte, objected to the affidavit filed by Saliya Ahangama and said that he (Saliya Ahangama) had sworn in his affavit as a Christian and at the end of the affidavit he had affirmed.

President's Counsel H.L. de Silva, senior counsel for Ahangama said that his client is a Christian (Baptist).

Mr. H.L. de Silva said that it was a mistake or an ommission.

Mr. Romesh de Silva said that it was not a mistake or an ommission.

At this stage Justice Edussuriya said that Christians sworn in, not very likely affirm.

Mr. H.L. de Silva:- This is an error, a mistake.

Mr. Romesh de Silva:- It is not a mistake or an error. Your Lodship, the law is very clear on this matter.

After submissions by both counsels the bench fixed argument for July 15.
