The ICC today released details of the ICC Cricket World Cup 2003 Technical Committee hearing and appeals, ahead of the Technical Committee meeting in Cape Town tomorrow, to consider the request from the England & Wales Cricket Board (ECB) to reschedule its match against Zimbabwe scheduled for 13 February in Harare.
In accordance with the ECB's request, the Technical Committee hearing will take place from 16.30 hrs at the Table Bay Hotel, Cape Town on Thursday, 6 February.
The Technical Committee consists of the following people:
Malcolm Speed, ICC Chief Executive, Chairman
Dr Ali Bacher, Executive Director, ICC Cricket World Cup 2003
Campbell Jamieson, IDI Commercial Manager
Brian Basson, United Cricket Board of South Africa
Sunil Gavaskar, independent member
Michael Holding, independent member
All members, with the exception of Michael Holding, have confirmed their availability for the meeting. Mr Holding is en route to South Africa, and the ICC is still seeking to confirm his availability. A minimum of four members are required to form a quorum for the Committee and if Mr Holding is unavailable, the hearing will proceed with the remaining five members.
Decision Making
The Technical Committee came into being on 2 February 2003 and is responsible for dealing with issues arising from the tournament playing conditions, including the re-scheduling of matches.
Decisions of the Committee are made by a majority vote, with the Chairman having a casting vote.
In the case of tomorrow's hearing, the Technical Committee will hear submission from the ECB as to the reasons it is seeking to have the match rescheduled and any evidence that is available to support this position. The ECB is to be represented by its Chief Executive, Tim Lamb, and legal counsel.
The Committee is free to call evidence from any other people it sees relevant and it is expected that the Committee will call on senior members of the ICC Cricket World Cup Security Directorate which has devised the Security Plan for the tournament and the independent risk consulting firm, Kroll, which provided a security report to the ICC Executive Board on the situation in Zimbabwe.
The Zimbabwe Cricket Union (ZCU) has also been invited to be represented at the hearing. At this stage, the ZCU has not advised the ICC is it will accept this invitation.
APPEALS
There is a right of appeal against decisions reached by the Technical Committee. In this case, either the ECB or the ZCU will be able to lodge an appeal.
The process for lodging and hearing an appeal is as follows:
  1. A Board has to lodge a written notice of appeal, setting out the grounds of the appeal within three hours of notification of the Technical Committee's decision
  • Within 12 hours of receiving such an appeal, the ICC will appoint one of the Appeals Commissioners. The Commissioner will be independent of the country lodging the Appeal.
  • The Technical Committee will provide a written statement to the Appeals Commissioner, setting out all relevant circumstances, within 12 hours of the appeal being lodged. A copy of this statement will be passed to the country as soon as possible after its receipt by the Appeals Commissioner
  • The Appeals Commissioner will hear and determine the appeal as soon as possible, and before the next match in which the country is scheduled to play
  • The process for conducting a hearing will be left to the discretion of the Appeals Commissioner. In most cases, the decision will be made on the written submissions from the Board and the Technical Committee. A hearing can though be held in person or by telephone conference. In any such case, the Board and Technical Committee will be given the opportunity to be present at or listen to all of the evidence, and to question any witness
  • The Appeals Commissioner will provide a written decision which will be forwarded to the Board, the Technical Committee and the ICC Chief Executive
  • The Appeals Commissioner has the power to amend or otherwise substitute his own decision for that of the Technical Committee, if he thinks appropriate to do so
  • The Appeals Commissioner's decision is final and binding The three Appeals Commissioners appointed for the ICC Cricket World Cup 2003 are Justice Ahmed Ebrahim, Zimbabwe, Justice Albie Sachs, South Africa, and Justice Richard Otieno Kwach of Kenya.
    As the matter relates to an issue involving Zimbabwe, Justice Ebrahim will not hear any appeal and one of Justice Sachs or Justice Kwach will be appointed if required.
