Justice Albie Sachs, the ICC Appeals Commissioner appointed to hear the England & Wales Cricket Board Appeal against yesterday's decision of the ICC Technical Committee, has confirmed the Directions he has given to both parties involved in today's Appeal hearing.
On Appointment by ICC Lawyer Urvasi Naidoo, Justice Sachs said: "It is clearly in the interests of all concerned that the Appeal is dealt with as rapidly as possible. At the same time, full consideration must be given to all the issues raised. I have accordingly prepared the following Directions to assist the parties and myself"
Those Directions are as follows:
  1. The Appeal is set down for a private oral hearing at 16:00 hours in Cape Town
  2. The legal representatives of the ECB to provide a written submission to Justice Sachs by 11.00 am on Friday 7th. A copy of this will be passed immediately to the ZCU
  3. Legal representatives of the ZCU will have the opportunity to reply succinctly in writing by 1.00 pm
  4. These Directions may be varied on good cause shown by timely application to myself (Justice Sachs)
  5. The legal representation for the ECB will have 30 minutes for oral presentation. The legal representation for the ZCU will have 30 minutes for reply
  6. The legal representative for the ECB will then have five minutes for argument in rebuttal
The Appeal hearing is taking place in private, but Justice Sachs' verdict will be given at a media conference in the Constantia Room, Holiday Inn (formerly Cape Sun) on Strand Street. This will take place no earlier than 19:00 hours on Friday 7 February. There will be no media access to the Constantia Room before this time.
