Dear Mr Sutherland,

RE: REPORT INTO ALLEGATIONS REGARDING MARK WAUGH BY M.K. GUPTA

As requested by the former Chief Executive Officer of the Australian Cricket Board I have inquired as to whether there was any basis upon which charges should be laid against Mark Waugh as a result of allegations made by Mr M K Gupta.

Over the last eight months I have conducted investigations and/or interviewed in excess of 60 people in four countries including many current and former Australian players and officials.

I have examined all reports and, where available, supporting evidence and transcripts published by Cricket Boards that have conducted inquiries into corruption and match fixing. I have extensively monitored many print and electronic media sources covering these issues and have held numerous discussions with investigators appointed by other Cricket Boards.

I have liaised closely with the International Cricket Council's Anti-Corruption Unit and have been granted access to relevant portions of their database as well as being assisted by their investigators.

I have also been provided with information from both the press and the public.

I attach my report.

You will note from the report that I have been unable to locate any reliable corroboration for Mr Gupta's allegations against Mark Waugh and that Mr Gupta is not prepared to be interviewed about, or give evidence in relation to, this matter.

As you are aware Mark Waugh has always denied the allegations and I can find no basis upon which to recommend any charges.
